STARBURST FIREWORKS TERMS & CONDITIONS

Please read the following Terms & Conditions carefully as they affect your rights and liabilities under the law and set out the terms under which Starburst Fireworks Ltd.sells products available to you for
purchase via its website www.starburstfireworks.com

TERMS OF CONTRACT
2.1 – These conditions apply to the contract to the exclusion of any other terms that the customer seeks to impose or incorporate, or which are implied by trade, custom, practice or course of dealing. Throughout this document the term “You” and “Customer” are interchangeable and for the avoidance of doubt they mean the person who intends to purchase products from Starburst Fireworks Limited. 2.2 – The Website order, catalogue order or verbal instruction constitutes an offer by the customer to purchase the Fireworks (Products) in accordance with these conditions. The customer shall ensure that the terms of the order are complete and accurate.

2.3 – The contract constitutes the entire agreement between the parties.

The customer acknowledges that it has not relied on any statement,
promise or representation made or given by or on behalf of Starburst Fireworks which is not set out in the contract. Any descriptive matter, or advertising issued by Starburst Fireworks and any descriptions or
illustrations contained in our website and catalogues or otherwise are issued or published for the sole purpose of giving an approximate idea of the fireworks described in them. They shall not form part of the contract or any other contract, or any other contract between Starburst Fireworks and the customer for the sale of the goods.

2.4 – Jersey law states that you must be 18 to legally buy fireworks.

2.5 – This company is committed to promoting the safe and legal sale of
fireworks.

2.6 – When delivery of the fireworks is attempted, we cannot leave
fireworks in the possession of any person who is under the age of 18
and Proof of ID may be required should we suspect that the person is
under the age of 18 unless we can safely satisfy ourselves in a phone call to you that you accept that you are happy for us to do so.

2.7 – On delivery, if no person of legal age is present and we have no
specific agreed instructions on where to deposit the goods ( in a safe place on your property as stated by you) then we will not deliver and you will have to incur additional charges for re-delivery or collect from
us on our terms.

2.8 – Whilst we make every effort to deliver your order within the dates you ask for at checkout, unfortunately we cannot guarantee the date of your delivery and Starburst Fireworks will not be liable for the failure of
the delivery due to circumstances outside its control or the customer’s failure to provide Starburst Firework 3.6 – After this time, you cannot amend your order.

3.7 – If we decline to supply an item to you and you have already paid for it, we will give you a full refund of any amount already paid for with that item in accordance with our refund policy.

CANCELLATION OF ORDER
You may cancel your order at any time up until the date of delivery that you have chosen. However goods cannot be cancelled on the day of delivery and will be charged at full cost.

REFUND AND DEFECTIVE ITEMS POLICY
4.0 – If you are entitled to a refund, we will refund you as follows, via cash, cheque or other means at our discretion within 30 days.

4.1 – Goods will only be refunded if the goods sold to the client are proved faulty.Your statutory rights are not affected. If you consider your goods to be defective in any way before use please contact us immediately. After use and whilst not returning to a firework once lit,
should a device fail to ‘go off’ or malfunction we will replace that damaged firework on inspection of the goods. Do not return to a firework once lit. Should defective fireworks be disposed of the offer of
a refund is at our discretion.
4.2 – If the defect is caused by misuse or negligence or by failure of you to follow the oral and or written instructions as to the storage, commissioning, installation, use and maintenance of the Goods it will not be classed as the manufacturers or sellers liability.

SAFETY
5.0 – All our goods are tested to BS 7114 part 2:1988 and the current European certifications as well and are fully complaint.

5.1 – You are requested to study the fireworks code and obey the
guidance given and to use fireworks in a safe and proper manner as indicated on safety instructions so supplied on the fireworks and leaflets therein.
5.2 – Starburst Fireworks will not be liable for any damage caused by the misuse of fireworks.

PRIVACY
6.0
At Starburst Fireworks Limited, we care about how your personal
information is shared. We take your privacy seriously and work hard to maintain our security procedures in order to protect your data.

The information we collect about you, if you agree to provide it, will
allow us to contact you and send information to you about products
and/or services where you have registered an interest.

In providing us your information you thereby consent to us processing
it for this purpose.

The data we collect about you

The information you give us may include; your name, address, email
address, IP address, phone number, together with financial information.

All of which is personal data and subject to the GDPR.

Information you provide to us When you use our website (www.starburstfireworks.com), we may collect personal information you have given us by completing forms.

We also collect information you provide when opening an account with
us, by entering into a contract with us, or by correspondence with us by email, letter, phone or other methods. This includes data provided by you when subscribing to newsletters or other information services,
placing an order for products or services, when reporting a problem
with our site, or otherwise contacting us.

Information we automatically collect

With regard to your use of our website, we may automatically collect
technical information – such as your; internet protocol (IP) address, timezone, browser type/version with plug-in types/versions, device
information (operating system and platform).

We may also collect information about your visit such as your Uniform
Resource Locators (URL), including the date and time, products viewed/ searched; site response times, downloads, errors, page visit time length, interaction (scrolling, clicks, mouse-overs), exit methods away from pages, route to our site from other websites, with the address of other sites, or from search engine links to our site including search engine address and search term used.

Information we receive from other sources

We may use third-party information, which may be combined with
information you have provided to us and/or information collected by us, which may be used for the purposes we have defined above.

How your information is used

The information we hold about you is used for account administration,
including opening up an account, verifying your identity, undertaking
credit related searches, invoicing, managing credit limits and payments. We also use your information to meet our obligations within any contracts between us and to meet your requests for information and/or products and services. We may also notify you of changes to our products or services or make suggestions/recommendations that may
interest you.

We may use information that we collect about you to manage our
website, as well as for our efficient operations, which includes analysis, research, statistical and survey uses, together with testing and troubleshooting; to improve our website and content for users and their devices; to allow you to interact with our website and take advantage of our online services whenever you may elect to do so; to ensure our site is safe and secure by monitoring activities within the context of continual process improvement, which is a best practice requirement of the GDPR; to monitor advertising and marketing effectiveness for users, and/or to fine-tune advertising by relevance to users; to enable targeted suggestions/recommendations to users about products and services that may be of interest.

disclose information (including personal information) to third party
suppliers and service providers, who we employ to perform tasks on
our behalf. These companies include (for example) our suppliers who
require customer information for warranty purposes, our website
analytics companies (e.g. Google Analytics) and email service

Contact form
Should you choose to contact us by using the contact form on our
website, the email address, name and phone number that you submit
will be stored on our website platform.

We consider these platforms to be third party data processors (see
section below). Your email address will remain within the platform
databases for as long as we continue to use these platforms, or until
you specifically request removal from the list.

How long we retain your information for

If you have an account with us or purchase goods/services from our
website, we will retain your information for as long we are required by law to retain that information, which is generally ten years. Thereafter the information will be destroyed without further notice.

Marketing Communications

You can opt-out of receiving certain marketing communications from us
at any time, by using the unsubscribe link in the emails
communications we send. If you are an active customer, we will still
send you non-promotional communications with regards to the services
we are providing.

Your legal rights Under certain circumstances, you have the following rights under data protection laws in relation to your personal data:

Principles (Article 5) of the GDPR. We have in place reasonable and
appropriate controls to ensure confidentiality and data privacy.

Starburst Fireworks Limited is only responsible for its own privacy
policy.

Our website may occasionally include links to or from other websites,
such as our brand suppliers and other affiliated organisations. Each of these websites is required under the GDPR to provide users with
access to their privacy policy.

COOKIES
7.0 – Cookies are small digital signature files that are stored by your web browser that allow your preferences to be recorded when visiting this website. Also they may be used to track your return visits to the website. Your continued use of this site is taken as indication of your consent to the use of cookies.
